Snek Technologies Armature Terms of Sale

Hello and thank you for trusting us with your new armature purchase. We know how important of a choice it can be, and hope you are excited to get in full possession of it soon. However, we have to press that additional terms may apply, and that consciousness transferral is a part of a highly legislated framework that defines the responsibilities, obligations and protections of all parties involved. This document lays down those terms, and some of the most common laws that can apply to you.

1. INTRODUCTION

Snek Technologies Incorporated (also in this document “Snek Technologies”, “Snek Tech”, “snek.technology”, “Us” or “We”) is a legal entity headquartered in Jumal (Ex-Apsensekeon), X3B-099-Y5Y, street address 29 Sublime Valley. Any reference to affiliated entities in this document (such as Snek Network, Snek Heavy Industries, etc.) should also be understood as a reference to Snek Technologies, with the immediate exception of Snek Holdings Limited. Snek Technologies can be contacted for general matters via infoΩsnek.technology.
You, the end-user, shall either be a person of legal age according to the government or transgovernment they depend of when finalizing the purchase, or have a legal guardian able to consent to those terms in your stead. You must also plan to actually use the product you’re purchasing.

2. PRODUCT

In the context of this agreement, an Armature is a self-powered conscience vessel (or SPCV) ; artificial ambulatory frames able to be piloted by an installed on-board sentience. Other common names include multiple variation of “body”, such as “artificial”, “android”, “robot” or “golem”.

This agreement covers the purchase of most Snek Heavy Industries Armatures, which are the ST-A1000 series up to ST-A1500 “Anniversary”, the Tactica I to Tactica V (but excluding the IV), and the CB-CSTM01. Any other model, including future ones, are assumed to have other terms applied to their purchase ; therefore, if you do not see the model of the Armature you are buying, you should warn a Snek Tech representative at once to get the terms that will actually apply to you. YOU MIGHT NOT BE PROPERLY COVERED BY THE LAW IF YOU FAIL TO DO SO.

Other popular models not covered by this present agreement includes the EM-3 emergency armature (or any EM- series) and the Tactica IV which uses more specific terms of sale. If you were handed this agreement when planning or after starting to use such an uncovered armature, you should get in touch with us at your earliest convenience.

3. PURCHASE

As stated before, the end-user purchasing the Armature must be intending to use it once the purchase finalizes. To avoid unfair reselling practices (“scalping”) and to comply with several sector-wide legislations, we restrict the purchase of our Armatures to physical entities who, in good faith, intend to use said Armature.
In some jurisdictions, the selling of Armatures is restricted to only physical entities with a Consciousness Transference Plan (CTP). If the purchase is made in such a jurisdiction, it is your duty to procure a genuine CTP before ordering or buying a Snek Tech Armature.
Furthermore, some jurisdictions consider the act of buying an Armature without a CTP to be a crime, even when finalized abroad. It is your duty to ensure you do not run afoul of the law when buying a Snek Tech Armature.

IN CT-STYLE GOVERNMENT SYSTEMS, THE OPEN TRADE OF ARMATURES IS STRICTLY ILLEGAL. CITIZENS SHOULD USE THE PROPER GOVERNMENTAL CHANNELS TO ACQUIRE OR EXCHANGE AN ARMATURE, AND REPORT ANY ILLICIT TRADE TO PUBLIC OFFICIALS.

SNEK HEAVY INDUSTRIES ARMATURES DO NOT COMPLY WITH BUTLERIAN REGULATIONS ON TECHNOLOGICAL PRODUCTS. PLEASE BE WARNED THAT THE BUTLERIAN SYSTEMS RECOGNIZE NEITHER UPLOADED NOR TRANSFERRED SENTIENCE, AND THAT TRANSPORTING, OWNING, OR USING AN ARMATURE OUTSIDE OF OFFICIAL DIPLOMATIC MISSIONS MIGHT RESULT IN FORCED IMMEDIATE DISASSEMBLY WITHOUT TRIAL OR PRIOR CONSCIOUSNESS TRANSFERENCE.

4. CONSCIOUSNESS TRANSFERENCE

Consciousness Transference, or ConTran, is any technology that enables a sentience to be installed, or “jump”, to another vessel (which includes Armatures). ConTrans are highly technical, involved, and legislated processes, of which the framework differs from jurisdiction to jurisdiction.
Therefore, we must insist that Snek Technology is not a Consciousness Transference Agency, and cannot perform such procedures on any member of the general public. Despite this, it will still be expected of you to present a CTP when asked by a Snek Tech representative, especially when required by the law. Furthermore, we make no promise to assist you in any procedure that involves the obtention of a CTP nor the ConTran itself.

4.1. CONSCIOUSNESS TRANSFERENCE ADDENDUM

Snek Technologies makes no systemic difference of consideration between organic and uploaded sentiences, as required by our mission statement and Galactic-Standard Law. When buying an Armature in a jurisdiction where a CTP is required, one will always be asked of you, be it your first ConTran or not.

5. DELIVERY

Snek Technologies and its partners will ensure that the delivery of the Armature is made to you within a reasonable time frame. However, please note that some circumstances might incur delay, such as (but not limited to):

Galactic-Standard Law forbids Armature manufacturers to impose any restriction on the usage of a SPCV, and therefore, we won’t. We do press the importance of understanding the mechanics, systems and features of your armature for maintenance and best operation, which you can look up in the end-user manual included with your purchase. Some actions might also alter or terminate the warranty on your Armature, detailed later in this agreement.
While Snek Technologies prides itself on having among the most stable firmware releases, we might push updates both online and via government agencies to fix system issues and instabilities. While Snek Tech cannot impose of you to go through with those upgrades, your government or transgovernment can. Moreover, we cannot press enough that you should absolutely upgrade if a firmware update is available, as out-of-date component can lead to disastrous health issues, including death.

For information, the current firmware release at time of printing is: FIRMWARE N°2 “NEVER OBSOLETE”
Replacing : FIRMWARE N°1 “UNBREAKABLE”

Moreover, Snek Technologies and its partners also offers general and purpose-built suites of embarked programs, or Specs, for purchase or download. Those are optional and not required for the continued usage of your Armature, but we still advise you to upgrade whenever an update is available for any one of your installed Specs.

For information, the current most common Spec versions are:

  • ALLSPEC V.5780 MK.8++ (SNEK TECHNOLOGIES)
  • CHARSPEC RAINBOW 10 (STARSIGN SOFTWORKS)
  • TACTICASPEC V.5 MK.3+ (SNEK TECHNOLOGIES)

7. WARRANTY

Please read this section carefully, as terms differ depending on the government or transgovernment you depend of.

IN CT, SD, AND TH-STYLE GOVERNMENTS, ARMATURE MAINTENANCE IS HEALTHCARE. Issues should be reported to a doctor specialized in SPCVs so that you receive better treatment. Payment is then negotiated between Snek Technologies and your healthcare provider, and in most cases should come at no cost to you.

IN OTHER STYLE GOVERNMENTS, ARMATURES THEMSELVES ARE PROPERTY EVEN IF THE SENTIENCE INSTALLED IS NOT. Warranty for all Snek Heavy Industries is of ten years minimum, and more wherever required by law. This warranty is limited to engineering defects, abnormal wear and tear, and eventual damage due do Snek Tech’s actions. It does not cover usual wear and tear, accidental or occupational damage, including by installing or modifying software or hardware, and self-harm.

For both cases, Snek Technology meets and surpasses Galactic-Standard law by providing perpetual material support in and out of warranty (though raw part costs might still apply).

7.1. WARRANTY ADDENDUM

We reiterate we cannot prevent you from using your armature in any way (as mentioned in section 6), which include modifying it. However, PLEASE NOTE THIS NOT ONLY VOIDS YOUR WARRANTY WHERE APPLICABLE, IT WILL ALSO DOWNGRADE SNEK TECH’S RESPONSIBILITY TO ADVISORY ONLY.

8. CHANGES TO TERMS OF SALE

No changes to this document and its effects can nor will be made without prior government or transgovernment approval. Therefore, when we require to do so, you will be notified both by electronic means on our side for your information and convenience, and by the government or transgovernment you depend of via certified mail.

9. DISPUTES, TERMINATION, CHOICE OF LAW AND VENUE

Surpassing Galactic-Standard Law, Snek Technologies do not make any attempt to restrict your legal rights when you enter this agreement. We will not unilaterally terminate this agreement, but you are free to do so at any time after good reception of your armature. And while we’d prefer for you to reach out if any issue arise (and better yet, we’d prefer for those issues never to happen!), in the case of any clam, dispute, controversy, or disagreement, you are free to start a negotiation process with us with or without a third party moderator, or start any court proceeding outright.

THIS AGREEMENT SHALL BE GOVERNED AND CONSTRUED IN ACCORDANCE WITH JUMALEAN LAW, WHICH OBEYS ALL GALACTIC-STANDARD SPCV REGULATIONS AS WELL AS TRADE REGULATIONS. THEREFORE AND UNLESS DECIDED OTHERWISE BY AN EXPLICIT COURT ORDER, PROCEEDINGS PERTAINING ANY DISPUTE CONCERNING THIS AGREEMENT ARE TO BE CONDUCTED BY A JUMALEAN COURT OF LAW.
